About the Council

 

Powers of council

The Powers and Duties of Council are outlined in clauses 73 to 76 of the Constitution of the Law Institute of Victoria Ltd.

Role of council

The Council’s role is:-

  • To ensure its directors, and the company generally complies with its obligations under its Constitution and the Corporations Act 2001
  • To formulate policy and shape the direction of the organisation
  • To be informed of the requirements of the membership by ensuring there is appropriate communication with the members of the organisation
  • To liaise with other interested parties and to communicate with the public in order to be informed of current opinion and to promote respect for the law and the legal profession
  • To monitor the performance of the organisation and manage risk

Role of management

The role of management is:
  • To put in place policies and procedures to ensure the company fulfils its obligations under Corporations law as delegated by the Council
  • To achieve strategic and operational outcomes
  • To communicate with members to determine their needs and put in place mechanisms to meet those needs through appropriate service provision
  • To keep abreast of government legislation and potential legislation and ensure that the LIV has a role in formulating policy to the benefit of its members and the community
  • To fulfil the regulatory role as delegated by the LSB/LSC
  • To assist Council in maintaining a public profile for the LIV as the peak legal body in Victoria
  • To ensure Council are kept informed of relevant issues and of organisational performance
The council comprises:

An elected council of 18 members governs the LIV.

  • Three suburban practitioners
  • Three city practitioners
  • Three country practitioners
  • One corporate practitioner
  • One legal aid practitioner
  • Seven other members who may fall into any category

Office bearers are: President, Vice President, Immediate Past President, Treasurer, and a fifth Executive member.

LIV Constitution

The principles under which the LIV is governed are encompassed in its Constitution.

  • The Constitution is reviewed on an on-going basis and may only be amended with the approval of the membership at the Annual General Meeting.
  • The last changes were made in November 2008 at the Annual General Meeting in which the proposed changes were approved. These changes are effective as of 1 January, 2009.
