International or Interstate Lawyers

International Lawyers

Foreign lawyers may practise the law of their foreign jurisdiction in Victoria, either as an Australian-registered foreign lawyer, or as a non-registered foreign lawyer.

They cannot practise Australian law, but can practise the law of the overseas jurisdiction in which they are currently registered. An Australian-registered foreign lawyer may also maintain an office and have a commercial presence in Victoria for this purpose. Non-registered foreign lawyers do not share this privilege, nor can they practise foreign law in Victoria for more than 12 months continuously.

Interstate Lawyers

As part of an initiative across Australia towards national practice, Victoria’s Legal Profession Act 2004 has given interstate practising certificates validity in Victoria . Interstate legal practitioners have the same right to engage in legal practice in Victoria as in their home jurisdiction but are subject to the requirements of the Legal Profession Act 2004 and all applicable legal profession regulations in Victoria .
