A. In 2000 (updated in 2006), the Law Council of Australia released its "Ethical Standards for Mediators" (pdf). The Standards have three major functions:
- To serve as a guide for the conduct of mediators.
- To inform the mediating parties.
- To promote public confidence in mediation as a process for resolving disputes.
The standards consider a number of ethical issues that arise in the mediation context, including:
- Effective communication with the parties about the process.
- Impartiality
- Conflicts of interest
- Competence
- Confidentiality
- Quality of the process
- Termination of mediation
- Recording settlement
- Publicity and advertising
- Fees
