Interstate Legal Practitioners
An interstate legal practitioner is a person who holds a current practising certificate in an Australian jurisdiction other than Victoria.
Registration requirements
There are no registration requirements for interstate legal practitioners practising in Victoria. However, an interstate legal practitioner who establishes an office in Victoria must give written notice to the Legal Services Board within 28 days of establishing the office.
Extent of entitlement to practise in Victoria
An interstate legal practitioner who establishes an office in Victoria:
- Is subject to the requirements of the Legal Profession Act 2004 and all applicable legal profession regulations
- Is not authorised to engage in legal practice in a capacity exceeding the jurisdiction authorised under a local practising certificate
- Has the same right to engage in legal practice in Victoria as in their home jurisdiction
- Is subject to the same conditions applicable to their right to practise in their home jurisdiction
- Can have conditions imposed on their practice by the Legal Services Board;
- Must not engage in unsupervised legal practice in Victoria unless they have completed the required supervised legal practice period either in Victoria, or interstate
