You will learn the practical considerations to be aware of, how to structure clauses to best meet your client's needs and takeaway helpful precedents that you can implement immediately in your day-to-day practice.

    In this practical session, Allan Swan, Principal of the Estate Planning Equation, will work through a series of complex issues in will drafting together with sample clauses to address them.

    Non-testamentary trust wills topics include:

    • Adjustment clauses:
      • Identification of non-estate assets
      • Identification of recipients - inclusion of “family group”
      • Valuation of amounts to be adjusted
      • Process if adjustment not possible
    • Superannuation streaming
    • Non-apportionment clauses
    • Appropriation clauses & taxation consequences
    • Superannuation proceeds trust
    • Authorising executor to claim superannuation

    Testamentary trust wills topics include:
