    Join Wills & Estates specialists and experienced practitioners to discuss the recent decision Re McGowan & Valentini Trusts [2021] VSC 154. Designed to update your trusts law knowledge and enhance your advisory skills in this area, this session will take you through the key takeaways from this case and give you the information you need to achieve better outcomes for your clients.

    In this practical session, Dr Philip Bender – Counsel in the McGowan matter – will take you through how the case was prepared, the key points of the decision, and will cover topics including:

    • the discussion on ownership of assets (whether by a trust or not) and its tactical relevance in litigation;
    • the possibility of a trust being able to be extended beyond its vesting date pursuant to the valid exercise of a variation power, rather than on a Saunders v Vautier rationale basis and the consequent resettlement considerations; and
    • a general analysis of trust resettlement and the identification of the trust substratum.

    As with all our Breakfast with the Experts events, attending this session will give you the opportunity to submit ‘questions on notice’ prior to the session and participate in a Q&A discussion with our presenter making this a valuable event for any senior practitioner.
