The communications you think may be protected by ‘without prejudice’ may actually not be and expose it to the danger of being part of the evidence.

    Designed in consultation with Accredited Specialists, this practical session will equip family law practitioners with a comprehensive understanding of protections and exceptions when the words ‘without prejudice’ are used as per sec 131 of the Cth Evidence Act (EA).

    In this session, Barrister Minal Vohra SC will use case scenarios to highlight key issues and provide insights to avoid compromising the proceeding without further delay, uncertainty and cost.

    • When the Court will look behind the privilege
    • Without prejudice communications in parenting proceedings
    • The Family Law Act and Rules and without prejudice communications.

    Minal Vohra S.C., Barrister, Victorian Bar

    Minal is the Victorian Bar Representative of the Family Law Section of the Law Council of Australia and has been since 2007. Minal completed the Australian Institute of Family Law Arbitrators and Mediators' arbitration course in 2008 and is an accredited Family Law Arbitrator and member of AIFLAM. She is an accredited Advocacy Instructor with the Australian Advocacy Institute and has taught at its advocacy training workshops and assisted with moots and evaluations for the Bar Readers' Course. She has a significant Mediation practice and regularly acts as Mediator. She is a Victorian Bar Conciliator and a member of the Bar's Cultural and Gender Diversity Working Group. She is a member of the Asian Australian Lawyers' Association and took Silk in November 2017. She is also member of the Victorian Bar Council.
