Buying off the plan is a common occurrence in Victoria and comes with its own set of unique risks and issues for all parties involved. Whenever there is a change to a property after a contract has been entered both parties have to negotiate the maze of materiality of the change and often need to consider potential contractual breaches or misleading and deceptive conduct. The consequences of being wrong are significant and remedies include forfeiture and return of the deposit as well as payment of damages.
