    The recent High Court decision of Thorne v Kennedy prompted an enormous response from the community at large regarding the validity of prenuptial agreements. How will this impact Australian family law and Victorian practitioners working in this space?

    The court held that a prenuptial agreement would not be enforceable on the basis of undue influence and unconscionable conduct, and has provided greater clarity on several issues resulting in guidelines for practitioners to consider.
