LIV Administrative Law Fact Sheets

The LIV’s Administrative Review & Constitutional Law Committee has produced a series of fact sheets that provide LIV members with succinct and user-friendly overviews of a range of administrative law issues.

Statutory Interpretation (PDF)

Statutory interpretation is a skill that every lawyer needs to be well versed in. Australian and Victorian law is overwhelmingly driven by laws by or under Parliament. This Fact Sheet contains relevant extracts from the Victorian and Commonwealth interpretation acts, as well as selected maxims and principles that can aid practitioners in interpreting both primary and subordinate legislation.

Privacy in Victoria (PDF)

With people becoming more aware about privacy risks, lawyers need to consider legal obligations and rights established by privacy laws. This Fact Sheet outlines the right to have personal and health information protected in Victoria and in the Commonwealth.

Freedom of Information (PDF)

This Fact Sheet outlines the process for exercising the right to access documents held by Federal and Victorian Government Ministers and agencies.

Administrative Decision Making Guide (PDF)

This guide outlines the issues that administrative decision makers need to consider when making decisions. It seeks to assist decision makers with making better decisions that have proper regard to people’s rights and interests and are less likely to be challenged in a court or tribunal. This guide should be used in combination with detailed training in administrative law.
