Competition & Consumer Law Committee Charter

Competition and Consumer Act 2010 (Cth)
The Australian Consumer Law (ACL) can be found at Schedule 2 of the Competition and Consumer Act 2010 (Cth). The ACL commenced on 1 January 2011 and is the national law for fair trading and consumer protection. It replaced consumer protection provisions in at least 20 different Commonwealth, state and territory laws.
The ACL includes provisions relating to:
  • misleading & deceptive conduct
  • unconscionable conduct
  • consumer guarantees
  • unfair contracts laws
  • national product safety law and enforcement system
  • national laws for unsolicited consumer agreements covering door-to-door sales and telephone sales
  • simple national rules for lay-by agreements
  • new penalties, enforcement powers and consumer redress.
Regulation of the Australian Consumer Law is managed jointly by the Australian Competition and Consumer Commission (ACCC), Australian Securities and Investment Commission (ASIC) and the relevant state and territory consumer protection agencies.
The ACCC enforces the Australian Consumer Law General and Specific Provisions.
The Australian Securities and Investments Commission (ASIC) enforces the ASIC Act in respect of consumer financial products and services.
