CPD Application for Exemption

You may apply for an exemption under Rule 16.3 and will need to provide evidence in support of your application. Evidence may be in the form of a statutory declaration, or a letter from your employer confirming your employment arrangements, with the exact start and end dates of the exemption period.
A lawyer may seek an exemption for CPD requirements based on defined grounds which include:

  • Illness or disability
  • the location of the solicitor’s legal practice
  • absence due to parenting leave
  • absence from legal practice
  • the solicitor has reduced hours of practice owing to part time or casual employment
  • the solicitor’s circumstances are such that the solicitor is required to hold a practising certificate but is not engaged in legal practice
  • the solicitor has been in practice for a period of 40 years and does not practise as a principal
  • hardship or other special circumstances

Accredited Specialists – Please note that if you are an Accredited Specialist, you are required to continue to meet your CPD obligations to maintain your Accreditation.   • End of CPD year – it is advisable to apply for an exemption prior to the end of a CPD year to ensure you are able to answer the CPD question correctly on your Practising Certificate Renewal Application
  • Practising Certificate Renewal Application – you have completed your recent application for renewal of pc and answered Yes to CPD question declaring compliance, an exemption is unable to be granted
  • Processing time - Ordinarily, Applications for Exemption will be processed within two weeks. However, during our peak period of February to May (coinciding with the end of the CPD year), the volume of applications increases significantly and means our processing time is approximately four weeks. To ensure your exemption is processed prior to 31 March each year, applications must be received no later than 28 February
  • Compulsory fields - Compulsory fields are required to be completed as part of any remaining pro rata CPD requirement – Rule 6.2
  • Evidence in support – applications cannot be processed if evidence in support is not provided

Once you have submitted your application an automatic e-mail response will be sent.  If you do not receive this e-mail the application has not submitted correctly.
