CPD Application for Exemption

You may apply for an exemption under Rule 16.3 and will need to provide evidence in support of your application. Evidence may be in the form of a letter from your employer confirming your employment arrangements, with dates, a medical certificate or a statutory declaration.

The LIV, as delegate of the VLSB+C, requires evidence in support to exercise the discretion and will consider all evidence provided, together with your history of CPD compliance, previous exemptions granted and period of absence from practice (if relevant), and will balance this against the community interest underpinning the CPD Scheme that all lawyers maintain high professional standards in deciding whether to grant an exemption in each case.

Please note:

  • End of CPD year – it is advisable to apply for an exemption prior to the end of a CPD year to ensure you are able to answer the CPD question correctly on your Practising Certificate Renewal Application
  • PC Renewal Application – you have completed your recent application for renewal of pc and answered yes to CPD question declaring compliance, an exemption is unable to be granted
  • Current CPD year -  unless there are exceptional circumstances, exemptions will only be granted for the current CPD year
  • Processing time - Ordinarily, Applications for Exemption will be processed within two weeks. However, during our peak period of January to April (coinciding with the end of the CPD year), the volume of applications increases significantly and means our processing time is approximately four weeks. To ensure your exemption is processed prior to 31 March each year, applications must be received no later than 29 February
  • Compulsory fields - Please note that exemptions are unable to be granted in relation to the compulsory fields unless the exemption granted is in full.  Therefore the compulsory fields are required to be completed as part of any remaining pro rata CPD requirement - Refer to Rule 6.2
  • Acknowledgement once submitted – Once you have submitted your application an automatic e-mail response will be sent.  If you do not receive this e-mail the application has not submitted correctly
  • Evidence in support – applications cannot be processed if  evidence in support is not provided
