The LIV Building and Construction Working Group provides a forum for LIV members to discuss the latest developments in building, construction, owners’ corporations, cladding safety and the Victorian Civil and Administrative Tribunal (VCAT). The Working Group also provides an opportunity to advocate on behalf of the profession. The Working Group has recently met with a variety of stakeholders in order to best represent the legal profession in these unprecedented times.  

The LIV Building and Construction Working Group sits within the LIV’s Property and Environmental Law Section. It is chaired by David McKenzie who also chairs the LIV’s Property and Environmental Law Section Executive Committee.

The Working Group met several times this year. Working Group meetings have involved discussions about topics such as the Domestic Building Dispute Resolution Victoria service, the impact of ‘force majeure’ clauses in commercial contracts during the COVID-19 pandemic, and the operation of the VCAT Building and Property List.

The Working Group met with several key stakeholders this year. In August the Working Group invited senior employees of Cladding Safety Victoria and the Victorian Building Authority to a meeting to discuss cladding removal options and owners’ corporation issues. This meeting enabled a valuable exchange between lawyers and the public sector. Following on from this meeting the Working Group met with a member of the Victorian Bar and several members of the LIV Property Law Committee to continue the discussion and decide how the Working Group can advocate on behalf of the profession in the cladding removal space.

In August the President of VCAT, Justice Quigley, and VCAT Deputy President Aird attended a meeting of the Working Group via Zoom. At this meeting Justice Quigley and Deputy President Aird addressed the Committee on VCAT’s operations and experience during the COVID-19 pandemic. The Working Group has reached out to stakeholders such as VCAT in order to raise issues and provide feedback in an effective dialogue.

The LIV commends all members of the Building and Construction Working Group for their hard work and dedication. Meeting and engaging with external stakeholders has enabled the Working Group to advocate on behalf of the Victorian legal profession during these uncertain times.
