On 9 October 2020, the LIV held its annual Succession Conference virtually for the first time. Despite the new format, the LIV has received feedback that it was of overall great value, that the speakers were engaging, and the topics were highly relevant. This included the regular use of polls, a live chat box, and lively wellbeing sessions.  Members of the LIV Succession Law Committee contributed to the planning of this Conference, and also regularly provide input into other succession law CPD events during the year. These events include:

  • Wills & Estates – Year in Review: Key cases of 2020 on 12 November 2020; and
  • Will Drafting Masterclass on 17 November 2020.

Being a member of the LIV Succession Law Committee provides a vital opportunity to ensure that LIV CPD sessions focus on key issues/areas directly relevant to the legal practice of succession lawyers. It also provides a unique opportunity to canvas any practice issues, to connect with like-minded peers, and contribute to law reform.

In 2020, the LIV Succession Law Committee looked at the following issues:

  • Testators Family Maintenance Practice Note SC CL 7;
  • Proposed amendments to the Status of Children Act 1974 (Vic);
  • Reform of Superannuation Death Benefits Nominations;
  • The creation of a TFM Handbook (‘the Green Book’);
  • NDIS privacy reform; and
  • The impact of remote witnessing and signing of powers of attorney, Wills and other testamentary instruments under COVID-19 Regulations.
