A tenant is required to pay the landlord’s legal costs in various situations such as an assignment of lease under s51(2) of the Retail Leases Act 2003 (Vic) (Act) or the preparation of a lease where the Act does not apply. Neither the landlord nor the landlord’s solicitor has an obligation to provide a costs disclosure to the tenant under Schedule 1 of the Legal Profession Uniform Law Application Act 2014 (Vic) (LPULAA), namely, the Legal Profession Uniform Law (Victoria) (LPUL).1 Nevertheless, LPUL is significant in assisting a tenant that believes the landlord’s legal costs are unreasonably high.
