Discrimination Marriage Equality 


Why all the fuss? In the present debate relating to marriage equality, it appears to me that the actual import of the sought amendment to the Marriage Act 1961 will mean very little indeed. What legal effect does the Act actually provide – what does a legal marriage do, apart from, for example, making bigamy a crime? We know that a marriage will revoke a will (s13 Wills Act 1997 (Vic)) and that a party to a marriage cannot seek an alteration of property interests in family law following the breakdown of the relationship if more than 12 months have elapsed since a divorce (s44(3) Family Law Act 1975)
