In Wingfoot Australia Pty Ltd v Kocak (Wingfoot)2 the High Court stated: “The function of a Medical Panel is neither arbitral nor adjudicative; it is neither to choose between competing arguments, nor to opine on the correctness of other opinions on that medical question. The function is in every case to form and to give its own opinion on the medical question referred to it by applying its own medical experience and its own medical expertise”. First established in 1989 to give opinions on “medical questions” to the then Accident Compensation Tribunal,3 the Medical Panel (Panel) has now evolved as a provider of medical expert opinions which must be accepted by a court in WorkCover proceedings.
