Council update The LIV Council meets each month to consider issues of importance to members, the legal profession and the community. At the 19 May meeting, Council considered a range of issues affecting the day to day procedures practitioners use, as well as the regulatory role of the LIV. Files The paper File Ownership, Retention & Destruction Guidelines was noted and discussed and Council resolved to approve amendments to it. Council noted the Ethics Committee had discussed data in the cloud with respect to the duty of confidentiality and the rules and would develop guidelines and standard terms specific to this. The Ethics Committee will liaise with the Technology and the Law Committee on the matter. Specialisation Specialisation Scheme Rules were discussed and Council resolved to endorse proposed amendments to rules: 4.4 – practical experience – introduction of a guideline defining “substantial involvement” 5.8 – leave of absence. Withholding tax Council was given an update on the foreign residents withholding tax regime, which comes into force on 1 July and will affect many practice areas. Council was told what the LIV is doing to inform and educate members on the new regime, including the practitioner guide and CPD. Commonwealth Law Conference Council was given an update on the Commonwealth Law Conference (CLC) to be hosted by the LIV in Melbourne in 2017. The draft program and registration fee schedule are now published on the CLC website. Regulation The February-May activities of the Taskforce on Regulation and Charitable Status [TORCS] were discussed by Council. Activities included consultation with expert advisers, LIV members and legal associations regarding planned meetings with the Law Society of England and Wales in London in light of regulatory developments unfolding in the UK. Council was told that regarding regulation, models ranged from a simple member services model to co-regulation. The historic attrition of the LIV’s role as regulator was outlined. Council was told the taskforce’s preliminary view on charitable status is that it is a commercially-based decision to be taken subject to there being no detriment to the LIV.
