WADA and state-sponsored doping

WADA and state-sponsored doping

By Tom Hickey, James Paterson and Garth Towan

Arbitration

Following WADA’s investigations into Russian sport, there is increased attention on arbitral awards relating to doping rendered by CAS. Recent controversies in international sport have highlighted that matters related to doping provide legal terminology, interpretation and jurisprudence unique to that field. One such matter is the restriction of many Russian athletes from competing at the 2016 Olympic Games in Brazil based on alleged doping offences and the issues raised by investigative reports commissioned by the World Anti-Doping Agency (WADA) and subsequent responses by the International Olympic Committee (IOC), International Federations for sports that schedule competitions in the Olympics (IFs) and Court of Arbitration for Sport (CAS).
