15 June marks Elder Abuse Awareness Day – a reminder that lawyers need to guard against inadvertent involvement in the financial abuse of vulnerable older people. Among the many shocking stories told to the Royal Commission into Family Violence were those detailing cases of elder abuse. Pam Morton and Jenny Blakey of Seniors Rights Victoria told the commission about a form of abuse that is perpetrated on a vulnerable older person mostly by trusted family members, usually by their adult children, and often takes the form of financial abuse. This commonly involves the misuse of power of attorney, adult children demanding their inheritance early, or parents being pressured to hand over assets in exchange for a promise of care.
