Capacity Guardianship

Advance care directives for future medical treatment are now enshrined in law. The Medical Treatment Planning and Decisions Act 2016, which came into force on 12 March 2018, changes the law regarding the medical treatment of people who do not have decision making capacity. These important reforms are based on recommendations made by the Victorian Law Reform Commission (VLRC) in its 2012 report “Guardianship”, which was the first major review of Victorian guardianship laws for 30 years.
