The Royal Commission into the Management of Police Informants provides a roadmap to reform the criminal justice system and restore public confidence in the legal profession, according to the Law Institute of Victoria.

LIV President Sam Pandya said it would take years to recover from the actions of Victoria Police and Nicola Gobbo’s impact on the criminal justice system.

He said the Law Institute of Victoria accepted the recommendations in the final report and would work with the Victorian Legal Services Board and Commissioner, Victoria Bar, Law Council of Australia and relevant legal profession stakeholders to implement the recommendations.

“We have always held that it is never appropriate to use a lawyer as a human source and it is a clear breach of their ethical obligations to the courts and their clients,” Mr Pandya said.

The consequences of acting as police informant could include breaches to lawyers’ duty to the court, honesty, independence, loyalty, confidentiality and failures to uphold client legal privilege.

He said the LIV already had a strong and robust ethical and education program for its 19,000 members.

The LIV is also expanding its resources as recommended in legal education, ethical education and wellness resources.
