Here are some 'law hacks' for budding legal eagles who wish to avoid common pitfalls in trial preparation and management. Being a trial lawyer at any level is not easy, let alone when you are novice to the profession. Law school rarely prepares you for what lies ahead in practical terms. In February 2014, I commenced as a first-year solicitor. Within weeks, I was enlisted to prepare a matter for trial in the Federal Court of Australia involving claims under the Australian Consumer Law, damages of which was quantified at around half a million dollars. I was thrown into the deep end of commercial litigation. Over a two-part series, I hope to share my experience and practical tips on discovery and in-court work to better navigate the terrain of commercial litigation as a young litigator.
