The Justice Legislation Amendment (Sexual Offences and Other Matters) Bill 2022 introduces complexities in the trial of sexual offences. New offences, including stealthing, provide additional protection for victims, while deepfake (computer generated images of a real individual) pornography are now recognised as a form of image-based abuse. Alongside these revisions, the shift towards an affirmative consent model (or a requirement for active verbal or physical consent prior to any sexual act) creates significant changes to criminal defence practice.
