Migration Lawyers can assist clients at any aspect of their migration to Australia including assessing visa options and pathways to permanent residency and citizenship.

LIV President Tania Wolff said the directory would also be useful for other lawyers looking to find immigration lawyers for matters where it may affect their client’s visa.

There are currently 130 lawyers listed on the directory which is available on the LIV website at www.liv.asn.au/MigrationLawyersDirectory.

Ms Wolff said the publication of the directory followed the end of dual regulation for migration lawyers. From Monday 22 March migration lawyers are able to offer services independently of the regulation framework for migration agents.

“This allows people seeking immigration assistance a clearer choice between lawyers and migration agents,” Ms Wolff said.

She said lawyers must demonstrate qualifications, fitness to practice and professional standards to retain their annual practising certificate. Lawyers are also covered by a professional indemnity insurance and fidelity fund to protect clients.

For clients seeking immigration advice, the LIV directory also identifies which lawyers are LIV Accredited Specialists. These lawyers must have a minimum of five years full time practice experience and a minimum of three years of experience in their area of specialisation. They must also pass a rigorous qualification process to attain accreditation and maintain a high level of ongoing professional development in immigration law.

Ms Wolff said migration lawyers were previously also regulated by the Office of Migration Agents Registration Authority (OMARA).

To be eligible to appear in the LIV Migration Lawyers Directory, lawyers must meet criteria including:

  • Be an LIV member; and
  • Hold a current Australian legal practising certificate; and
  • Not be subject to any disciplinary actions by the Victorian Legal Services Board, any other State/Territory, legal regulator or OMARA.
